Eligibility: The Whatareyouinto.net HOT 100 (the "Contest") is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Mitsubishi Motors North America Inc., 426, Inc. and their respective parents, subsidiaries, and agents, and any agencies or other companies involved in the development or execution of the Contest or production or distribution of Contest materials, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law.

Agreement to Official Rules: By participating in the Contest, entrant fully and unconditionally agrees and accepts these Official Rules and agrees that the decisions of the Sponsor and/or Administrator, which shall be final and binding in all matters related to the Contest. Whether an entrant's entry is selected as a winner is contingent upon fulfilling all requirements set forth herein.
Timing: The Contest begins on July 10, 2010 at 12:00 a.m. Eastern Time ("ET"), and ends on November 15, 2010 at 11:59 p.m. ET (the "Contest Period"); 426 Inc.’s computer is the official time-keeping device for the Contest.

Entry Terms, Conditions and Restrictions:
The Entry is the original work of the Entrant and have not been copied from another individual or entity;
The Entry does not harm or bring into disrepute the name, goodwill and reputation of Mitsubishi Motors North America Inc. or any other entity;
The Entry do not include any information that references other websites, email addresses, personal information or any material that may be damaging to another individual or entity;
The Entry do not contain any viruses, Trojan horses, worms, or any other similar software, data, or programs that may potentially damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, information, computer programs or files, or property of another;
The Entry must not contain HTML or other web coding or phone numbers;
The Entry must not include any controversial, inappropriate, confrontational, excessively personal, or violent, drug-related, unlawful, or sexual content. They must not include any discriminatory or negative remarks concerning any person or group.
The Entry must not include content that suggests that readers should obtain products from another business.
The Entry must not contain any profanity (including creative spellings such as #$%@), obscenity, inappropriate innuendo, or inappropriate slang.
The Entry must not contain personal information, such as full names, phone numbers, specific physical addresses, e-mail addresses, or URLs, (including cases where enough information is included such that personal information can be inferred) or than within the specific contact information prompts.
Entrant also warrants and represents that the display or publication of the Entry by Mitsubishi Motors North America Inc. and does not and will not infringe or violate the rights of any other party, including any copyright interests. Entrant agrees to indemnify, defend and hold Mitsubishi Motors North America Inc. harmless from any losses, claims, damages, awards, penalties or injuries incurred, including reasonable attorney's fees, which arise from any claim by any third party of an alleged infringement of copyright or any other property right arising out of the display or publication of the Entry
Entrant hereby irrevocably grants and assigns any and all rights in the Entry to Mitsubishi Motors North America Inc. The Entry shall be considered a work made for hire within the meaning of the Copyright Revision Act of 1976 (as amended) and that Mitsubishi Motors North America Inc. shall be considered the author of the Entry and entitled to all rights to which an owner of copyright is entitled under this Act, or the copyright laws in any country, including without limitation, the right to revise and supplement the Entry, or any part thereof. Mitsubishi Motors North America Inc. shall have all rights to use, publish, reproduce or display the Entry, including images of the aforementioned Entry, in all media now known or hereinafter devised, and in all territories worldwide, in perpetuity.
Entrant understands that the selection or use of the Entry is in Mitsubishi Motors North America Inc.’s discretion and Mitsubishi Motors North America Inc. is not obligated to use, publish or display any Entry submitted as part of the Contest, and waives any right to rescind any rights granted in this Release.
In addition to the General Conditions listed in Section 11, Sponsor, in its sole discretion, may terminate the Contest at any time during the Contest Period, but prior to the selection of Winners. Multiple entrants are not permitted to share the same e-mail address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods, will void that entrant's entries and that entrant may be disqualified. Proof of submission or sending an essay is not proof of receipt by Sponsor. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned.
Winner Selection: An independent judging organization whose decisions as to the administration and operation of the Contest and the selection of the potential winners are final and binding in all matters related to the Contest, will begin selecting Contest winners on an ongoing basis starting on or around July 15, 2010. In the event that Sponsor ends the Contest early, all outstanding Entry Phase prizes (any unclaimed spots within the ‘HOT 100’) will be awarded via random drawing from amongst all eligible Entries received during the Contest Period.
Criteria for a submission to be selected as a ‘winner’ includes (but is not excluded to) the following:
The accuracy of a submission (as determined by the judging organization)
The submission’s adherence to the stated Terms and Conditions (as determined by the judging organization)
The submission’s uniqueness to other submissions (as determined by the judging organization)
The submission’s timeliness (as determined by the judging organization)
The submission’s relevance to Mitsubishi, M-GEN, and being ‘Different for a Reason’ (as determined by the judging organization)
Winner Requirements: Administrator will notify potential winners via mail, phone or e-mail. Each potential winner will be required to respond to Administrator's notification with his/her intent to accept the prize within three (3) days from the date the initial notification is sent. Each potential winner will also be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release (the "Affidavit"), where permitted, to Administrator within seven (7) days from the date initial notification is sent. Failure to respond to the initial notification within the specified time frame, failure to return the Affidavit within the specified timeframe or noncompliance with these Official Rules will result in disqualification and forfeiture of the applicable prize. Any potential winner agrees by submitting their entry to accept the prize for their personal use and will not attempt to sale, transfer for profit any part of the prize package. In the event that a potential winner is disqualified for any reason, an alternate potential winner will be selected in accordance with the Winner Selection criteria as set forth in Section 6 of these Official Rules. This procedure will repeat three (3) times, after which the applicable prize will not be awarded. Prize will be fulfilled 6 to 8 weeks after all winners have been confirmed.
Prizes: 100 prizes of one (1) $100 dollar bill Prizes are subject to availability and blackout dates. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a Contest prize depend on the number of eligible Entries received during the Contest Period. Approximate Retail Value for a prize is $100.00.
Publicity: Acceptance of any prize shall constitute and signify the winner's agreement and consent that Sponsor may use the winner's name, address (city, state), likeness, and/or prize information for contextual purposes worldwide, including the internet, without limitation and without further payment or consideration, except where prohibited by law. If requested, winner agrees to conduct any and all media interviews (including but not limited to radio and television) related to the Contest.
General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but, not limited to, fraud, virus or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes in a random drawing from among all eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release and Limitations of Liability: Except where prohibited, by participating in the Contest, entrants agree to release and hold harmless Sponsor, 426, Inc., and their respective parents, subsidiaries, affiliates, and their respective agents and agencies, and their respective officers, directors, employees and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Contest or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Contest and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another Contest entry; provided that if it is not possible to award another entry for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Disputes: Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively Federal District Court for the Northern District of Illinois or any court of competent jurisdiction of the State of Illinois located in Cook County, Illinois, and the parties hereto irrevocably submit in any such suit, action or proceeding to the jurisdiction of said courts and waive any and all objection to such jurisdiction that they may have under the laws of the State of Illinois or the United States and any right to challenge the convenience of Illinois as an appropriate form. (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
Privacy: Information collected from entrants is subject to Sponsor's Privacy Policy, and will not be shared, presented, offered, or sold to any third party unaffiliated with the Sponsor.
